Terms of Service

The following Terms of Service are for both Naru Kim / narukim72 / JJnaru, from here on known as The artist and the person who requires her services for any of the art commissions she offers, from here on know as The client1. About this ToS.
- These Terms of Service are bound to change without notice for any reasons the artist sees fit in the future, please beware of that whenever you ask for a commission.
- Violating these terms will terminate the transaction between the client and the artist. If a refund is needed, it will be issued according to the specifications in the Payment & refunds. clause.
- The artist is not responsible if the client fails to read the Terms of Service.
- Should the client resort to harmful behavior, harass (sexually or otherwise), threaten, make any attempt to contact the artist in person or ask for personal information, the transaction between the client and the artist will be terminated with no refund, the client will be blocked and no more transactions will be done with them in the future.
- The Terms of Service are non-negotiable unless stated otherwise.2. Dos and Don'ts.
- The artist will not accept requests for commissioned pieces that involve: Explicit sex, self-harm and suicide, hate speech, terrorism, mecha, realism, political/religious propaganda and Sanrio characters
- The artist may or may not accept requests for commissioned pieces that involve: Gore, full nudity, weapons, heavy armor, monsters, animals, extreme detail, real people. These options are open for discussion via email.
- The artist is happy to accept requests for commissioned pieces that involve: Original characters, romantic relationships (including self-insert fanart, BL, GL, polyamory), lgtbq+ characters, fanart, partial nudity, pin-ups, 3. Payment & refunds.
- The client can only do the payment through Paypal via invoice sent by the artist, however; if the client resides in Peru they may transfer the money to an Interbank account.
- Full payment is required before the artist starts working on the client’s piece.
- The client may pay only 50% beforehand to save a slot in the commission queue and the other 50% once the artist is ready to start working on the piece. Spots in the queue are considered by the date in which the client submitted their form, while the order in which the artist starts working on a commission depends on the amount of current works in progress they have and the date in which the client submits the full payment.
- 100% Refund: Available only if the client cancels the project before the artist starts working on it or if the artist cancels the project for reasons other than the client violating the Terms of Service.
- 50% Refund: If the client cancels a project mid-way, as long as the piece is NOT in the final stage.
- NO Refund: Once the commissioned work is finished or in it’s final stage.3.1. On extra fees.
- Rush fee: If the client wishes their commission to be priority, they will be charged an extra free in agreement with the artist not lower than 25% extra. If the deadline is impossible to handle, the request will be rejected before any payment is made.
- Iterations: Every commissioned work has a range of 2 to 4 iterations for free depending on the price. Mistakes of the artist are not considered iterations (such as: missing a detail from a character with a reference sheet or misreading a color name.). If the client asks for changes such as: changing their mind about a pose, adding a different hair-piece to a character or switching a character’s gender it counts as an iteration. The artist will specify the amount of iterations the client gets before an invoice is sent. Complex changes to the piece are ok during the sketch stage only. Any complex changes done to the piece during the last stage of it will incur an extra fee, depending on the complexity of it, regardless of the number of iterations the client has left.
- Complexity: The artist will review the form the client sent and depending on the amount of details the piece requires, they will decide if an extra fee is needed before sending an invoice. The amount of money and complexity will be negotiated between both parties, should they not reach an agreement, the commission will be denied.4.About the artwork and its usage.
- The client is aware that the artist offers a paid service for digital artwork and that no physical products are to be shipped.
- The artist holds the rights to every commissioned artwork, therefore it may be worked on during livestreams on twitch and be posted on social media and other sites as portfolio by the artist. The client may specifically request for the piece to remain private, however; this may cause the artist to take more time to finish it. If a request for privacy is not made on the form, the artist is not responsible for the client’s lack of communication in this regard.
- All pieces requested are for personal use only. Should the client wish to commission a piece for commercial use, a fee should be negotiated with the artist. Commercial use is understood as: re-selling the piece physically or digitally, redistributing or gaining profits from the commission in some other way. If the client wishes to print the piece or turn it into merchandise for their own personal use, it won’t be considered as commercial use. The usage of commissioned emoji packs on Twitch or discord are not considered commercial use by the artist.
- The artist has a right to claim 100% of any profits gained from any unauthorized commercial use.
- The artist will never use commissioned artwork as merchandise, re-sell them digitally or otherwise to any other party that is no the client. Streaming the creation of the artwork is not considered as commercial use.
- If the client requests an artwork which contains characters, places, etc. from existing shows, books, games, etc. They will be responsible for any copyright issue that may arise.
- The client is allowed to post their commission or use it anywhere in social media as long as the artist is properly credited with a link to the twitter profile in a visible and public way. Removing the artist’s signature from the artwork, altering the piece in any way, copy or tracing it is not allowed. Collaboration commissions may be discussed.5. Work process and final delivery.
- After a request is sent, the artist will take 24hrs or less to reply via email. A price will be negotiated with the client and only after both parties are in agreement, an invoice with the required payment in USD will be sent. Only for residents in Peru, bank deposit in PEN (Soles) will be an option. If a payment is made in Peruvian Soles, the exchange rate will be of the day the invoice is sent.
- Once payment is settled and done, a date for starting the client’s work will be settled. Speeding fees will influence their position int eh queue as well. Any potential client may check the queue here.
- The artist will remain in constant contact with the client in regards to the piece. Any delay on feedback might delay the artwork itself. Should the artist face any difficulty outside their control (accidents, illness, etc.) which would cause any delays, they will inform the client as soon as possible.
- The artist has a right for two days off (saturday and sunday) any sort of communication regarding commissions will be attended only on working days, unless the client needs to be informed of delays or something extremely urgent, like stated on the point before.
- Once the commissioned artwork is completed, the client will receive the following files via wetransfer:
- - Full resolution flattened PSD
- - Full resolution JPG file
- - Low-resolution PNG file (for social networks)

Términos y condiciones

Los Términos y condiciones detallados a continuación son para Naru Kim / narukim72 / JJnaru, de aquí en adelante mencionada como La artista y la persona que requiera los servicios de comisión de arte que ofrece, de aquí en adelante conocida como El cliente1. Sobre los TyC.
- Estos Términos y Condiciones pueden cambiar en cualquier cualquier momento sin previo aviso por razones que la artista vea necesarias en el futuro, por favor tenga en cuenta esto al encargar una comisión.
- La violación de estos términos dará por terminada cualquier transacción entre el cliente y la artista. Si un reembolso es necesario, se otorgará de acuerdo a lo especificado en la cláusula de Pagos y Reembolsos.
- La artista no es responsable si el cliente no lee los Términos y Condiciones.
- Si el cliente realizara algún tipo de conducta agresiva, acosara (sexualmente o de otra forma), amenazara, tratase de contactar a la artista en persona o pidiera su información personal, la transacción entre el cliente y la artista se dará por cancelada sin derecho a reembolso, el cliente será bloqueado y no se volverá a hacer tratos con este en el futuro.
- Los Términos y Condiciones no son negociables a menos que se detalle lo contrario.2. Qué es aceptable y que no.
- La artista no aceptará comisiones que involucren: Sexo explícito, auto-mutilación y suicidio, apología al odio, terrorismo, mecha (robots), realismo, propaganda política o religiosa y personajes de Sanrio
- La artista puede o no aceptar comisiones que involucren: Gore, desnudos, armas, armaduras completas, monstruos, animales, detalle extremo, personas reales. Estas opciones se pueden discutir por correo.
- La artista está feliz de aceptar comisiones para piezas que involucren: Personajes originales, relaciones románticas (incluyendo fanart del cliente con un personaje ficticio, BL (yaoi), GL(yuri), relaciones polyamorosas), personajes lgtbq+, fanart, desnudo parcial, pin-ups, 3. Pago y Reembolsos.
- El cliente sólo podrá hacer el pago via Paypal a través de un invoice enviado por la artista, sin embargo; si el cliente reside en Peru pueden hacer la transferencia a una cuenta de Interbank.
- El pago completo es necesario antes de que la artista empiece a trabajar en el proyecto de el cliente.
- El cliente puede pagar el 50% del total como un anticipo para guardar cupo en la cola de espera, y el otro 50% una vez que la artista vaya a dar inicio a su comisión. Los cupos en la lista de espera se consideran en orden de llegada desde la fecha en la que el cliente envió el formulario de pedido, mientras que el orden en el que la artista inicia la comisión depende de los trabajos ya pendiente y la fecha en la que el cliente envía el pago completo.
- Reembolso del 100%: Disponible solamente si el cliente cancela el proyecto antes que la artista empiece a trabajar en este o la artista cancele el proyecto por motivos diferentes a que el cliente haya violado alguno de los Términos y Condiciones.
- Reembolso del 50%: Se da si el cliente cancela el proyecto a medio camino, siempre y cuando la obra NO esté en la última etapa de desarrollo.
- SIN Reembolso: Una vez que el proyecto esta terminado o en su última etapa.3.1. Costos extras.
- Tarifa de prioridad: Si el cliente desea que su comisión se haga antes que otras, se les cobrará una tarifa de prioridad acordada con la artista que no será menor al 25% extra. Si la fecha límite es imposible de manejar, el pedido será rechazado antes de que se haga algún pago.
- Cambios: Toda comisión tiene un rango de 2 a 4 cambios gratuitos dependiendo del precio de la comisión. Los errores de la artista no cuentan como cambios (por ejemplo: olvidar el detalle de un personaje que tiene hoja de referencia, poner el color equivocado en donde ya se dió indicación, etc). Si el cliente pide cambios como: alterar una pose por completo, añadir más adornos al cabello o cambiarle el género a un personaje, cuentan como cambios. La artista especificará la cantidad de cambios que el cliente puede hacer sin cobros extra antes de enviar el invoice. Se puede hacer cambios complejos al dibujo únicamente en la etapa de sketch. Cualquier cambio complejo hecho durante la última etapa del arte ocasionará un cobro adicional, que dependerá de a complejidad del cambio, sin importar la cantidad de cambios gratuitos que le queden a el cliente.
- Complejidad: La artista revisará el formulario de el cliente y dependiendo de la cantidad de detalles de la pieza a trabajar, se decidirá si es necesario cobrar una tarifa extra antes de enviar el invoice. El precio de la tarifa y el nivel de complejidad será negociado por ambas partes, si no llegaran a un acuerdo, se cancela el pedido.4. Sobre el arte comisionado y su uso.
- El cliente está al tanto de que la artista ofrece servicios de arte digital y que no se le enviará ningún producto en físico.
- La artista tiene los derechos de todo el arte comisionado, por lo que puede ser trabajado durante streams en Twitch y ser subidos a otros sitios para funcionar como portafolio de la artista. El cliente puede especificar que su comisión sera privada, sin embargo; esto puede ocasionar demoras en el avance de su comisión. Si no se hace el pedido de privacidad en el formulario, la artista no es responsable por la falta de comunicación de el cliente en este aspecto.
- Todas las comisiones son sólo para uso personal. Si el cliente desea comisionar arte para uso comercial, se debe negociar una tarifa con la artista. Se entiende como uso comercial: re-venta de la pieza digital o físicamente, redistribuir o sacar ganancias de la comisión de alguna manera. Si el cliente desea imprimir su comisión o convertirla en mercadería para uso personal, no se considera como uso comercial. El uso de los packs de emojis en Twitch o discord no se considera como uso comercial por la artista
- La artista tiene derecho a reclamar el 100% de las ganancias generadas por cualquier uso comercial no autorizado.
- La artista nunca usará el arte comisionado como mercadería, para re-venta digital o a alguna persona o empresa que no sea el cliente. Hacer streaming de la creacion de la comisión no se considera como uso comercial.
- Si el cliente comisiona arte que contiene personajes, lugares, etc. de algún show, libro, juego, etc. ya existente, tomarán responsabilidad por cualquier issue de copyright que pueda ocurrir.
- El cliente tiene permitido el subir su comisión o usarla en redes sociales, siempre y cuando la artista reciba el crédito apropiado con un link a su perfil de Twitter en un lugar visible y público. Quitar la firma de la artista de la comisión, alterarla de alguna manera, copiar o calcarla no está permitido. En caso de ser una comisión de colaboración, se puede hacer excepciones acordadas antes del pago de la comisión.5. Proceso de trabajo y entrega.
- Después de hacer el pedido, la artista tardará 24hrs o menos en ponerse en contacto via email con cada el cliente. Un precio será negociado y sólo después de que ambas partes lleguen a un acuerdo, se enviará un invoice con el pago requerido en USD (dólares estadounidenses). Sólo residentes de Perú tienen como opción hacer el pago via transferencia bancaria en Soles. Si el pago se llegase a hacer en soles peruanos, la tarifa de cambio será la misma del día en la que se haga el requerimiento de pago.
- Una vez que el pago esté completo, se dará la fecha de inicio de la comisión de el cliente. La tarifa de prioridad influenciará esto también. Cualquier cliente potencial puede revisar el estado de la lista de espera aquí.
- La artista permanecerá en contacto constante con el cliente en relación a la comisión. Cualquier demora en dar cambios o correcciones puede demorar el progreso de el arte en sí. En caso la artista tuviese alguna dificultad fuera de su control (accidente, enfermedad, etc.) que cause alguna demora importante en el proyecto, le informará a el cliente lo más pronto posible.
- La artista tiene derecho a dos días libres (sábado y domingo) cualquier tipo de comunicación sobre comisiones serán atendidas durante días hábiles, a menos que el cliente deba ser informado con urgencia de algun imprevisto o demora, como se especifica en el punto anterior.
- Una vez que el arte comisionado está terminado, el cliente recibirá los siguientes archivos a través de wetransfer:
- - PSD en alta resolución de 1 capa
- - JPG en alta resolución
- - PNG en baja resolución (para redes sociales)
